3-Year Manufacturer's Guarantee
§ 1 Guarantor

§ 2 Subject and Scope of the Guarantee
2.1 The guarantee applies to all network streamers manufactured by 64bitAudio UG (haftungsbeschränkt) and sold to consumers and entrepreneurs via the online shop at https://www.64bitaudio.de.
2.2 We guarantee that the device is free from material and workmanship defects during the guarantee period under normal, intended and proper use.
2.3 In the event of a guarantee claim, we will, at our discretion, either repair the device free of charge or replace it with an equivalent device. There is no entitlement to repair or replacement at the customer's choice. Replaced parts become our property.
2.4 A repair or replacement does not extend or renew the original guarantee period.
§ 3 Guarantee Period
3.1 The guarantee period is 3 years and begins on the day the device is handed over to the customer.
3.2 The date of the invoice or delivery note is decisive for the start of the guarantee period. Please keep these as proof of guarantee.
§ 4 Territorial Scope
The guarantee applies to devices that were purchased in Germany and that are also located in Germany at the time the guarantee is asserted.
§ 5 Conditions of the Guarantee
5.1 The prerequisite for making a guarantee claim is:
- a valid proof of guarantee (invoice or delivery note),
- the proper use of the device in accordance with the instructions and notices provided with the product,
- the report of the defect within the guarantee period,
- the possibility of clearly assigning the device to an order delivered by us on the basis of internal hardware features.
5.2 The guarantee is tied to the hardware. In the event of a private resale or a private gift of the device, the remaining guarantee claim passes to the new owner. The guarantee period begins on the date of the original purchase and is not extended by a change of ownership.
5.3 When making a guarantee claim, the new owner must present the original invoice of the first buyer as proof.
5.4 An isolated transfer of the guarantee claims without the device is excluded. The transfer in the course of a commercial resale (e.g. by refurbishment dealers or resellers) is not covered by this guarantee.
§ 6 Exclusions and Limitations
6.1 The following are excluded from the guarantee in particular:
- damage caused by improper handling, operating errors or non-compliance with the notices provided with the product,
- damage due to external influences such as falls, impacts, moisture, liquids, heat, frost, excessive exposure to dust (e.g. in a workshop environment) or force majeure,
- damage due to overvoltage, lightning strike or the use of a power supply that does not meet the specifications we have specified,
- damage due to unauthorised interventions, repairs or hardware or software modifications to the device,
- devices on which the security seal lacquer on the housing screws has been broken, damaged or removed. The security seal lacquer is located on the screws on the underside of the device and indicates that the device has not been opened since delivery,
- damage demonstrably caused by the use of unsuitable or faulty accessories, third-party software or the faulty connection to other devices (e.g. defective amplifiers or sources),
- cosmetic impairments that arise from normal use and do not affect the function of the device,
- devices that can no longer be assigned to an order delivered by us on the basis of internal hardware features, for example because central hardware components (in particular the mainboard and storage medium) have been replaced,
- data losses or consequential damages that arise from a defect or in the course of the repair. The customer is advised to back up important data themselves before sending the device in.
6.2 This guarantee covers exclusively hardware defects. Software updates are governed by § 8 of our GTC.
§ 7 Asserting the Guarantee
7.1 In the event of a guarantee claim, please contact us first via the contact form on our website. Alternatively, you can also reach us by email at contact@64bitaudio.de. Please describe the defect and have the following information ready:
- your order number or invoice number,
- a brief description of the defect,
- where possible, photos or videos showing the defect.
7.2 We will review your request and usually get back to you within 5 working days with the further procedure. If it is necessary to send in the device, we will provide you with a shipping label.
7.3 Please only send in the device after prior arrangement with us, in order to avoid delays in processing.
§ 8 Shipping Costs
8.1 When making use of the statutory liability for defects within the first 24 months from delivery of the goods, the shipping costs for sending the device to us and back are free of charge for you. We will provide you with a free shipping label for this purpose.
8.2 When making use of this voluntary manufacturer's guarantee after expiry of the statutory liability for defects (from the 25th month), we will provide you with a shipping label. The shipping costs for sending the device to us amount to a flat rate of EUR 7.00 and are borne by the customer. Payment is made in advance; further information will be provided to you together with the shipping label.
8.3 The return shipping of the repaired or replaced device to you is free of charge in all cases.
8.4 If, after examination, it turns out that there is no guarantee or warranty case (e.g. because an exclusion ground under § 6 applies), we will inform you of this and, on request, provide you with a cost estimate for a chargeable repair. If you decide against a repair, we reserve the right to charge you for the cost of return shipping.
§ 9 Relationship to the Statutory Liability for Defects
9.1 This manufacturer's guarantee is granted in addition to the statutory warranty claims. It neither limits nor replaces them.
9.2 The statutory warranty claims are available to you free of charge. Within the statutory limitation period of two years from delivery of the goods, consumers are entitled to subsequent performance (repair or replacement delivery), withdrawal from the contract or a reduction of the purchase price, as well as to damages in the event of fault. For entrepreneurs, the warranty periods set out in our General Terms and Conditions apply.
9.3 Making use of this guarantee is voluntary and is available to you in addition to your statutory rights.
§ 10 Final Provisions
10.1 Should individual provisions of this guarantee declaration be or become invalid, the validity of the remaining provisions shall remain unaffected.
10.2 The law of the Federal Republic of Germany applies. With respect to consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
10.3 The place of performance and the exclusive place of jurisdiction for disputes with entrepreneurs arising from this guarantee declaration is Berlin. For consumers, the statutory provisions on the place of jurisdiction apply.
10.4 We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
